Authorized employees within the company are on a need to know basis, and only use any information collected from individual customers in a professional capacity. We constantly review our systems and data to ensure the best possible service to our customers. Federal and state governments have created specific offenses for unauthorized actions against computer systems and data. We will investigate any such actions with intent to prosecute criminally and/or take civil action to recover damages against those responsible. Age, Criminal History & User Location Restrictions Persons under 18 years of age, persons who are not lawful residents of the U.S. or U.S. citizens traveling abroad, and persons who are prohibited from possessing firearms are prohibited from using this site in any capacity, including but not limited to placing orders. By using this site, you affirm under penalty of perjury that you do not meet prohibited criteria. We are staunch 2nd Amendment supporters and our personal beliefs are that all restrictions are infringements, but this is a business, and in order for it to remain one, we play by the rules, however silly or distasteful they may be. States where silencers are banned: Because we abhor “good for thee but not for me” public policy, we will NOT sell suppressors or any other items citizens are disallowed to government agencies in California, Delaware, Hawaii, Illinois, Massachusetts, New Jersey, New York or Rhode Island. The sole exception to this policy is sales to a law enforcement agency in which the current CLEO has publicly and in an official capacity denounced the state’s infringement of its citizens’ constitutional right to keep and bear arms. We do support law enforcement and understand that LEAs have little to no input on legislation, but if your sheriff or chief hasn’t done this on behalf of the people, we cannot in good conscience sell to the agency. With the same sole exception above, any person found to be distributing our products to government agencies or agents in jurisdictions where citizens are prohibited from possessing the same will have their account immediately and permanently revoked. California: due to new legislation further oppressing the citizens of California, as of 01 January 2026, California government agencies & agents are forbidden from procuring any ECCO Machine product, used or new. The distribution of any of our products to any California government agency or agent is STRICTLY PROHIBITED. Any person found to be distributing our products to California government agencies or agents will have their account immediately and permanently revoked. There are NO exceptions to this prohibition. Civil action may also be taken against individuals/entities who violate this policy. Additionally, in keeping with the sale prohibition, any ECCO Machine product sold to any California government agency or agent after 01 Jan 2026 is transferred in violation of this policy and shall have NO WARRANTY. Ordering Products We will not ship any of our products outside of the United States, nor will we ship products to states within that U.S. that we know to prohibit that product. We do not know all local laws & ordinances; if you order a product that is prohibited in your location, and we ship it with the tacit understanding that it is not prohibited, you accept full responsibility for any consequences you suffer. If you place an order for a suppressor or firearm, we will need copies of the valid FFL & SOT for the receiving licensee. Orders will not be processed until we have received those. If after 3 business days we have not received the transferring licensee’s information or a communication from you indicating that you are working on getting it, we may cancel and refund your order. Occasionally there may be inventory errors on the site due to software updates or glitches, cached pages allowing an order to be placed for an item that is out of stock or orders placed for the same item in rapid succession before inventory has updated. In the event that the item you order is not in stock, we will immediately cancel & refund the order and notify you with an apology. Backordering products is not enabled on the site and is generally not something we allow. Sales always apply to in stock items ONLY; we do not do “rain checks” or otherwise give discounts for items that were not in stock during a sale. Requests for Unethical or Unlawful Items or Services We will not knowingly violate any law or use any protected intellectual property without permission. If we suspect a customer is attempting to cause us to violate a law or make unauthorized use of intellectual property, we may discontinue all communications and we may refuse to return any monies or property in our possession until the matter is settled to our satisfaction. Any items sent to us which are evidence of a crime may be turned over to the appropriate authorities. Deceptive or Dishonest Acts If we become aware that you have tried to deceive us or been dishonest with us, we will consider it a breach of contract. This includes the use of an alias or other fictitious/misleading contact & identification information. You may be permanently ineligible for our services or purchasing products from us, we may terminate communication, and you may forfeit any and all goods or monies we possess for the indefinite duration of our investigation if we deem it prudent. If the deception is criminal in nature, we may involve law enforcement. Any tortious act may face civil action. *We do not consider the use of a common abbreviation (ex. Bob vs Robert) or initialism (ex. J.P. vs John Paul) of a first name, or going by your middle name, to be a deceptive alias. A person named Adam P. Smith submitting Harry M. Snyder would be a deceptive Alias. Intellectual Property Any domestic or international unauthorized use, sale, distribution, dissemination, duplication, counterfeiting or reproduction in part or whole of any ECCO Machine, Inc. intellectual property or the intellectual property of the company’s principles or employees, including but not limited to part geometry, product designs, product names, including commissioned or custom parts designed or redesigned by us, whether or not it is trademark, copyright or patent protected, is strictly prohibited and will be pursued in criminal and/or civil litigation. The ECCO Machine name and logo are registered trademarks of ECCO Machine, Inc. and counterfeit or inappropriate use of trademarks will be pursued in criminal and/or civil litigation. IP use/theft/distribution or counterfeiting that runs afoul of ITAR or trade laws will be referred to the appropriate agency for criminal prosecution in addition to civil litigation. A violation of this intellectual property section immediately and completely voids any express or implied contract, confidentiality or privacy obligation from ECCO Machine, Inc. Reviews must be approved for publishing by us. We will publish all honest reviews from verified customers/product owners, provided that they do not contain profanity or other deliberately offensive/inflammatory language. Product reviews are not a communication forum, please use our “contact us” page or our published email addresses for communication. People who leave dishonest reviews or people who are not customers who attempt to leave negative reviews will not have their review published and will be blacklisted, ineligible for any of our products or services forever. Confidentiality Client records are regarded as confidential and therefore will not be surrendered to any third party without a legal warrant/subpoena. Clients have the right to request sight of, and copies of any and all Client Records we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Clients with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties. Electronic documents will be provided via email free of charge, paper copies that must be sent by carrier may require payment for packaging and shipping costs. We do not use any other email domains for communication with customers, so if you receive a message that appears to be from us but comes from a Gmail, Hotmail, Protonmail, AOL or any other domain, please forward it to us and do not respond to the sender, as it is fraudulent. Even if it reads @eccomachine.com, that is not us; we are a .net domain. Log Files We use IP addresses to analyze trends, administer the site, track’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission. Custom orders/Pre Orders When ordering a custom item or pre-ordering an item that isn’t available yet or is in development, refunds will be available for 30 days from the date of the purchase/deposit or until manufacturing has commenced, whichever comes first. After 30 days or once production has commenced, that deposit or pre-payment is final. Persons who fail to pay the balance on a product or service upon completion, including any applicable storage or late payment fees, will be ineligible for any of our products or services until the balance is settled. Payment for products & services Payment for products or services is due upon ordering in the case of stock items, or upon completion in the case of custom parts or services. No items will be shipped/shipped back until invoices are paid in full. Balances not settled within 30 days of being due may be subject to a late payment fee of $15 per month. Items which were sent in for service may also be subject to storage fees of $5 to $15 per month, depending on item size, after 30 days if arrangements were not made for us to store your items for a longer period. Any customer who disputes a charge for an item shipped or a service rendered will be ineligible for any of our products or services, and for any express or implied warranties on our products or services, for an indefinite duration that is at our sole discretion, and we may choose to not communicate with you. Any “chargebacks” will be sent to collections, and may be investigated for fraud. If you have a problem, talk to us; we are very honest, reasonable and customer satisfaction oriented, but we do not take kindly to furtive actions. Shipping & Receiving Policies We only receive packages at our licensed address; ECCO Machine, 37245 Quail Dr. Elizabeth, CO 80107. Do not send a parcel intended for ECCO Machine, Inc. to any other address. Do not send us any contraband items. We will ship NFA regulated items only to other SOT FFLs or directly back to the owner identified on the federal form 5320.1/4/5 or verified trustee of the trust identified on the form in accordance with law and carrier policies. Recognized abbreviations of first names are acceptable, but do not use an alias. GCA regulated Title I firearms we receive for service we will only ship back to the person who sent them in or an FFL. GCA firearms we sell must transfer to an FFL. We will not ship our products or any other ITAR & export controlled items outside of the United States of America, and our services are not available to international customers, including foreign governments. We also will not receive regulated imported items, as we are not a licensed importer. We are a DDTC registered and ITAR compliant manufacturer as required by law. If we discover a person or entity is using a domestic address as a staging point to receive our products for international distribution or to facilitate international use of our services, we will halt any pending shipments, hold any items sent for service and report the activity to the State Department Insurance and Shipping Insurance All customer items are fully covered while in our possession, though it is the customer’s responsibility to provide accurate & truthful documentation of exact value or replacement cost should a claim need to be filed. We provide shipping insurance for item value on all of our products when shipped using our free shipping option. When another shipping method is selected, the customer is responsible for electing to insure the item and for the amount of insurance purchased. Where customer items being returned after service are concerned, shipping is calculated on a case-by-case basis, and we recommend electing to insure your item for at least full replacement cost, including any shipping, fees or taxes paid (for example, a silencer that was purchased for $799 + 8% sales tax +$100 dealer transfer fee + $200 tax stamp should be insured for $1,163 or more). When we provide the shipping label, customers are required to work with us on filing any insurance/shipping insurance claim for loss or damage to an item or items to determine which party will file the claim and what is required to move forward with a claim. Failure to work with us, to “keep us in the loop” may be considered fraud and could result in criminal and/or civil prosecution. In the event that a customer item is lost or damaged while in our care or in shipping from us on a label we provide, repair or replacement costs will be based on current average market cost/value as best it can be determined in the absence of a legitimate appraisal. Appraisals that seem to be illegitimate or inflated may be challenged and could constitute fraudulent activity. Items sent to ECCO Machine for service, exchange, refund or warranty with a customer or 3rd party procured shipping label: It is the responsibility of the customer to select appropriate shipping methods & insurance, and to deal with any carrier loss or damage claims, though we will provide any documentation we can to assist with the claims process. As detailed in our shipping instructions, neither ECCO Machine nor our insurance provider bears any responsibility for items which are claimed to have been sent here but which were not documented in the itemized shipping manifest. We do photograph all incoming parcel contents and documents, and will make contact with our customer immediately if an item that is supposed to be present is not found, or if there appears to be any damage that occurred in transit. ECCO Machine is not responsible for carrier loss or damage and will not cover any loss if the customer elects to purchase no shipping insurance, to insure for less than replacement cost, or for the loss of any items which the carrier has delivered/claims to have delivered without collecting a signature from our staff. Shipping to addresses other than FFL premises address: This is permitted by federal law, and we will do it in accordance with our carrier policies. In order for us to ship regulated items to an address other than the FFL premises, the alternate address MUST be visible on FFL EZ check. It is your responsibility to determine if state law in your state allows this; if we come to know that you tried to have us do this in violation of your state law, we will revoke the account. Credit/Debit Card Processing Credit/Debit card information is not stored in any fashion by the company; our merchant processor is responsible for all PCI related matters regarding securing the data. All processing is directly and securely linked to their portal for all processing; we have no access to the actual credit card numbers entered except for the last 4 digits of the card. Your credit card safety is our priority and we will do everything within our power to insure it stays safe. We will not request your card information by phone, text or email or paper mail, and you should not volunteer it outside of the Authorize.net secure portal we use for invoicing.
